Misleading Statistic · Medium confidence

The 40 lakh figure was the count of people left out of the July 2018 draft Assam NRC, not a count of proven illegal immigrants; the final NRC in August 2019 left out 19.06 lakh, and MHA says it holds no central data on infiltrators.

Government's response

Assam BJP Barak Valley leader on the 'termite' remark

A local BJP leader said the remark referred to Bangladeshi Muslim infiltrators rather than Bengali-speaking Hindus (title from search result; article not opened).

Analysis

On 22 September 2018, speaking at Gangapur in Rajasthan, Shah said Bangladeshi migrants were like termites who would be removed from the voter list, adding that the government had 'prima facie identified nearly 40 lakh illegal immigrants' through the NRC (PTI via Daily Excelsior).

The 40 lakh number matches the people not included in the draft Assam NRC published on 30 July 2018. Inclusion in or exclusion from the draft was an administrative step: those left out could file claims and were not declared foreigners. The final NRC (31 August 2019) excluded 19,06,657 of about 3.3 crore applicants, less than half the draft figure, and those excluded retain appeal rights to Foreigners Tribunals.

MHA has told Parliament that it cannot estimate the number of illegal migrants (Lok Sabha, July 2018, per press summary), and in an RTI reply dated 23 January 2026 reported by The Wire it said it holds no centrally compiled data on identification or deportation of infiltrators. In January 2026 Shah said at Dhemaji, Assam, that infiltrators in seven districts had reached 64 lakh (reported by Organiser; no verbatim quote available); no official dataset supporting that figure was found.
